Terms of Service

1. The agreement

These Terms of Service ("Terms") are an agreement between you and Willy de Camargo Bueno (CNPJ 57.192.787/0001-58), Avenida Salvador Tomás de Farias 18, Centro, Sapopema – PR, CEP 84290-000, Brazil ("Draftful", "we", "us") for the use of the Draftful website, app and related services (the "Service"). By creating an account or using the Service you accept these Terms. If you use Draftful for a company, you confirm you're authorized to accept them for that company, and "you" includes it.

Our Privacy Policy explains how we handle personal data and is part of these Terms.

2. The Service

Draftful helps businesses plan, write, fact-check and publish SEO content with AI. It analyzes your website, researches topics and keywords, drafts articles and images, and, if you connect them, reads your Google Search Console and Google Analytics data to report on performance and suggest updates. It can also monitor how AI assistants mention your brand. Features differ by plan and may change as we improve the product.

3. Accounts and workspaces

• You must be at least 18 and use Draftful for business purposes.
• Give accurate account information and keep your login secure. You're responsible for activity under your account.
• A workspace belongs to its owner. The owner controls who has access, their roles and the workspace's connected services, and is responsible for the actions of the members they invite.
• Only add websites, and connect Google properties, that you own or are authorized to manage.

4. Plans, billing and cancellation

Free trial

New accounts can generate a limited number of articles for free, without a payment card. The trial allowance is per account holder, not per workspace, and doesn't expire.

Subscriptions

• Paid plans are billed in advance, monthly or yearly, through Stripe, and renew automatically until you cancel. Prices are shown on our pricing page and at checkout, and may exclude taxes.
• Each plan includes a monthly article allowance and other limits. Unused articles don't carry over. Extra article packs you buy don't expire and are used after your plan allowance.
• Upgrades take effect immediately and you're charged the prorated difference. Downgrades take effect at the end of the current billing period.
• If a payment fails, your plan stays active for 7 days while you update your payment method. After that, the account returns to trial limits, and you can still read and export your content.
• We may change prices for future billing periods. We'll tell you at least 30 days in advance, and you can cancel before the change applies.

Cancellation and refunds

You can cancel at any time in Settings → Billing. Cancellation takes effect at the end of the current billing period and you keep access until then. If you're not satisfied, you can ask for a full refund of your first payment on a paid plan within 14 days of that payment by emailing contact@draftful.app. Otherwise, payments are non-refundable except where the law requires. Nothing in these Terms limits any rights you have under consumer protection law.

5. Your content

"Your Content" means what you put into Draftful (your website details, brand information, instructions, uploads and edits) and what the Service generates for you (briefs, articles, images and reports). As between you and us, you own Your Content, to the extent the law allows ownership of AI-generated material.

You give us a limited license to host, copy, process and transmit Your Content only to provide, secure and support the Service for you. We don't use Your Content, or data from your connected Google accounts, to train AI models.

You're responsible for having the rights to what you put into Draftful, and for making sure that uploaded images, brand assets and instructions don't infringe anyone else's rights.

6. AI-generated content

Draftful uses AI models to write and check content. AI output can be inaccurate, incomplete, similar to other content or unsuitable for your audience, even after our quality checks and fact-checking.

• You're responsible for reviewing content before you publish it and for what you publish, including any claims about products, health, finance or law.
• If you enable autopilot publishing, you authorize Draftful to publish or send content to your destinations without manual review each time, and you remain responsible for that content.
• We don't guarantee any search ranking, traffic, AI-assistant mention or business result.

7. Connected services

You can connect third-party services such as Google Search Console, Google Analytics and your own webhooks. Your use of them is governed by their terms, and we're not responsible for them. We access connected services only with your permission, only to provide the features you use, and as described in our Privacy Policy. You can disconnect them at any time.

Draftful's use of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.

8. Acceptable use

You agree not to use Draftful to:

• Create or publish content that's illegal, defamatory, hateful, deceptive, sexually explicit involving minors, or that infringes intellectual property or privacy rights.
• Publish spam, create sites intended to manipulate search engines at scale, impersonate others, or mislead people about who wrote the content where disclosure is required.
• Analyze or connect websites or Google properties you aren't authorized to manage.
• Break the usage policies of our AI providers or of Google.
• Get around plan limits, share accounts to avoid paying, or resell the Service without our written agreement.
• Probe, overload, reverse engineer or disrupt the Service, or access it by automated means other than the interfaces we provide.

9. Our property

We own the Service, including its software, design, prompts, scoring methods and brand. These Terms don't give you any rights to them except the right to use the Service while your account is active. If you send us feedback, we may use it without any obligation to you.

10. Suspension and termination

You can stop using Draftful and ask us to delete your account at any time (see Deleting your data).

We may suspend or close your account if you seriously or repeatedly break these Terms, fail to pay, or create a legal or security risk for us or others. Where reasonable, we'll warn you first and give you a chance to export Your Content. We may also discontinue the Service with at least 30 days' notice and a prorated refund of prepaid fees.

11. Disclaimers

We work to keep Draftful available and accurate, but the Service is provided "as is" and "as available". To the extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement, and we don't promise the Service will be uninterrupted or error-free.

12. Limitation of liability

To the extent the law allows, neither party is liable for indirect, incidental, special or consequential damages, or for lost profits, revenue, traffic or data, even if advised they were possible. Our total liability for all claims about the Service is limited to the amount you paid us in the 12 months before the claim arose.

These limits don't apply to liability that can't be limited by law, such as for fraud, or for death or personal injury caused by negligence.

13. Indemnity

You'll defend and indemnify us against third-party claims arising from Your Content, the content you publish, or your breach of these Terms or of the law.

14. Changes to these Terms

We may update these Terms. We'll post the new version here and update the effective date. For material changes, we'll tell you by email or in the app at least 30 days in advance. If you keep using Draftful after the change takes effect, you accept the new Terms; if you don't agree, you can cancel before then.

15. Governing law

These Terms are governed by the laws of Brazil, and disputes will be decided by the courts of the district of Sapopema, State of Paraná, Brazil. If you're a consumer, you also keep the protection of the mandatory laws of the country where you live and can bring claims in its courts.

16. General

These Terms are the entire agreement between us about the Service. If a provision is unenforceable, the rest stays in effect. Not enforcing a provision isn't a waiver. You can't transfer these Terms without our consent; we may transfer them in a merger, acquisition or sale of assets.
